Applicable to all coaching sessions, consultations and training services.
By participating in services provided by Peak Performance Climbing (PPC), you acknowledge that climbing and physical training activities involve inherent risks, including the risk of injury.
You confirm that:
You are 18 years of age or older
Participation is voluntary
You are physically capable of participating safely
You will inform PPC of any relevant injury or medical condition
You understand PPC coaching is educational in nature and not medical advice
You accept responsibility for participating within your own physical limits
You understand that participation in climbing, strength training and related activities may involve risks that cannot be completely eliminated.
By proceeding with PPC services, you acknowledge and accept these risks and agree to participate voluntarily.
Please review the following policies and agreements before participating in Peak Performance Climbing services.
These guidelines are intended to create a clear, safe and professional coaching environment for all participants.
LIABILITY WAIVER & PARTICIPATION AGREEMENT
This section outlines the risks associated with climbing and physical training activities and explains participant responsibilities.
1. Scope of Services
This Agreement applies to all services provided by Peak Performance Climbing (PPC), including:
Private climbing coaching
Semi-private and group coaching sessions
Online coaching and remote programming
Training plans and assessments
Guided outdoor climbing sessions and excursions
Technique analysis and video review
Climbing-related educational services and communication
Participation in any PPC service constitutes acceptance of this Agreement.
2. Participant Eligibility & Medical Readiness
By participating in PPC services, you confirm that:
You are physically capable of participating safely in climbing and training activities
You will disclose any relevant injuries, medical conditions or physical limitations
You understand that PPC does not provide medical diagnosis or treatment
You agree to seek appropriate medical advice where necessary
You acknowledge that participation should cease immediately if you experience pain, dizziness, illness or physical discomfort during training or climbing activities.
3. Assumption of Risk
You acknowledge that climbing, strength training and associated physical activities involve inherent risks that cannot be completely eliminated.
These risks may include:
Falls and impacts
Muscle strains and overuse injuries
Tendon, ligament and joint injuries
Equipment misuse or failure
Environmental hazards during outdoor climbing
Fatigue, dehydration or exertion-related illness
Accidents occurring during unsupervised or remote training
You voluntarily accept and assume all risks associated with participation in PPC services and accept personal responsibility for your own safety and well-being.
4. Online Coaching & Remote Training
For online coaching and remote programming services, you acknowledge that PPC cannot directly supervise your training environment.
You agree that:
You are responsible for ensuring your training environment is safe and suitable
You will only attempt movements and exercises you understand and can perform safely
You will use appropriate safety equipment where required
PPC is not responsible for injuries arising from unsupervised execution of exercises or climbing activities
5. Outdoor Climbing & Guided Sessions
For outdoor climbing sessions and guided activities, you acknowledge that environmental conditions may introduce additional risks, including weather, loose rock, terrain hazards and other unpredictable factors.
You agree to:
Follow all safety instructions provided by PPC coaches or guides
Use appropriate personal protective equipment
Disclose any relevant equipment limitations or concerns before participation
6. Limitation of Liability
To the fullest extent permitted by law, Peak Performance Climbing excludes liability for:
Personal injury, illness or death arising from participation in PPC services
Property loss or damage
Indirect, consequential or economic loss associated with participation
Nothing in this Agreement excludes rights that cannot lawfully be excluded under Australian Consumer Law or applicable legislation.
7. Indemnity
You agree to release and hold harmless Peak Performance Climbing, its coaches, contractors, employees and affiliates from claims, liabilities, costs or expenses arising from your participation in PPC services, except where liability cannot lawfully be excluded.
8. Media Consent
Unless otherwise requested in writing prior to participation, you consent to PPC using photographs or video footage taken during coaching or climbing activities for promotional, educational or marketing purposes.
All media will be handled in accordance with applicable Australian privacy legislation.
9. Accuracy of Information
You confirm that all information provided to PPC regarding your physical condition, injuries, experience level and participation history is accurate and current.
You agree to promptly notify PPC of any changes relevant to your participation.
10. Governing Law
This Agreement is governed by the laws of Victoria, Australia. Any disputes arising in connection with this Agreement shall be subject to the jurisdiction of the courts of Victoria.
11. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
COACHING AGREEMENT
The following policies apply to all ongoing coaching subscriptions and retainer-based services provided by Peak Performance Climbing.
1. Coaching Structure
Coaching is structured as an ongoing development relationship focused on climbing progression, performance management and long-term athlete development.
2. Coaching Inclusions
Online coaching subscriptions may include:
Individualised climbing and strength programming
One monthly program consultation
One monthly coaching check-in
Messaging support
Program adjustments and video feedback
Specific inclusions may vary depending on the selected coaching service.
3. Commitment Period
Online coaching operates on a minimum 3-month commitment to allow sufficient time for structured progression, assessment and program adjustment.
4. Subscription & Billing
Coaching subscriptions renew automatically on a rolling basis until cancelled.
Monthly and fortnightly billing options may be available depending on the selected coaching service.
5. Cancellation Policy
Cancellation requests must be submitted before the next billing cycle.
Once a billing cycle has renewed, payments are non-refundable.
6. Communication
Messaging support is intended for coaching-related communication, feedback and programming guidance.
Response times may vary depending on coaching hours and workload.
7. Scheduling Responsibilities
Clients are responsible for booking included consultations within the appropriate coaching period.
Missed or unused consultations may not roll over unless otherwise agreed upon.
8. Client Responsibility
Clients are responsible for participating within their own physical limits, managing training load appropriately and communicating honestly regarding injuries, fatigue and recovery.
9. Disclaimer
Coaching services provided by PPC are educational in nature and are not a substitute for medical, physiotherapy or allied health treatment.
GENERAL TERMS & CONDITIONS
1. Booking & Scheduling
Clients are responsible for attending scheduled appointments and arriving on time.
PPC reserves the right to reschedule services where necessary.
2. Cancellation & Refunds
Cancellations made less than 24 hours before scheduled sessions may be forfeited.
Subscription payments are non-refundable once a billing cycle has renewed.
3. Participant Conduct
Participants are expected to follow all climbing gym rules, safety procedures and coaching instructions during all PPC sessions and activities.
4. Privacy
Personal information collected by PPC is handled in accordance with applicable Australian privacy legislation and is used solely for coaching, communication and business administration purposes.
5. Governing Law
These Terms & Conditions are governed by the laws of Victoria, Australia.
ACKNOWLEDGEMENT
By participating in Peak Performance Climbing services, you acknowledge that you have read, understood and agreed to the policies and agreements outlined on this page.
